Public Hearing Report Adopted at Council Meeting

The public hearing for the planning proposal was held on Wednesday 22nd February 2023. Thank you to all those who have shared their thoughts with us.

Following the Public Hearing, a report was prepared by an Independant Chair which provided a summary of the public hearing, and discussed any submissions or comments received during the Hearing which was provided to Council and made available to the public within 4 days of the public hearing. A Council Report was then prepared and heard at the March Council meeting which recommended the Planning Proposal proceed to finalisation. This recommendation was carried unanimously by Councilors; therefore, Council prepared the finalisation report, and the Planning Proposal was sent to the Department of Planning and Environment (DPE) to finalise as the Plan Making Authority. The Department of Planning and Environment will provide further correspondence on the progress of the Planning Proposal, and this information will be made available in the near future.

Planning Proposal to reclassify Council owned land from 'Community' to 'Operational' at Centre Road, Moama

Lot 3 DP813704, Centre Road, Moama is a 200 hectare parcel of land located approximately 13km north-east of Moama’s town centre. The land came into Council ownership on 29 August 2018 as part of an agreement with a third party to purchase the land from Council and subsequently construct an ethanol plant. The third party chose not to pursue the purchase of the land from Council and has now ceased their plans to establish an ethanol plant in Moama. Council retained ownership of the subject land with the aim to eventually provide a site for future commercial activities near the Moama township. As the site is currently classified as 'community land', before any future potential for this site can be realised, the land is required to be reclassified to 'operational land' via a Planning Proposal. At the Council meeting on 23 August 2022, Council endorsed Planning Proposal 2022-2347, which if adopted will:

  • Use the provisions of Clause 5.2 of the Murray Local Environmental Plan 2011 (LEP) to reclassify Lot 3 DP813704 from ‘community land’ to ‘operational land’.
  • Amend Schedule 4, Part 1 of the Murray LEP 2011 to include Lot 3 DP813704

Council is required to undertake a number of formal processes, which have been detailed in the Planning Proposal. All the documents and information associated with the Proposal are available in the 'key documents' panel to your right. As no formal plans for the site have been finalised, there are no plans or designs for a included as part of the Planning Proposal. Any future development of the site will be subject to a future process at a later date.

    At the Council meeting held on 14th March 2023, Council reviewed any submissions received as part of the consultation process and the Public Hearing Report submitted to Council on 01 March 2023.

    Council have endorsed the Public Hearing Report and have elected to take the final steps to finalise this proposal.

    On 01 March 2023, we received a copy of the Public Hearing Report produced by the independent facilitator of the Public Hearing.

    A copy of the report is available for viewing at the Murray River Council Head Office, 52 Perricoota Road, Moama.

    It will also feature in the Agenda for the extraordinary Council meeting being held on Tuesday 14th March 2023. The contents of the Public Hearing report and any views expressed by the community will form part of the Council report for the decision.

    The Public Hearing for the reclassification of the land known as Lot 3 DP813704 Centre Road, Moama, is on this Wednesday!

    Please note, there are no active NSW Public Health Orders, however, if you would like to attend, please note the following recommendations:

    • Masks are encouraged to be worn in crowed, indoor places; and
    • Physical distancing of at least 1.5 metres from other people is encouraged.

    A reminder - if you are interested in attending you do not need to register to attend, however, there will be an attendance sign-in sheet upon arrival to complete. If you have further questions, please contact Council on 1300 087 004 or sending an email to admin@murrayriver.nsw.gov.au.

    Location: Moama Recreation Reserve Pavilion, 52 Perricoota Road, Moama, with a 5pm start, please arrive 15min before the start time to allow us to start on time.

    The public consultation period for the planning proposal has now concluded. Thank you to all those who have shared their thoughts with us.

    The next step is to hold a Public Hearing to continue the conversation about the reclassification of the community land associated with this Planning Proposal. We will be holding the Hearing on Wednesday 22nd February 2023 (Moama Recreation Reserve Pavilion - 52 Perricoota Road, Moama). This forum will be chaired by an independent facilitator who is not associated with or employed by Council. This is an opportunity for you to share your feedback specifically on the reclassification of Lot 3 DP813704, Centre Road, Moama, with someone external to Council. The facilitator will seek your thoughts at the forum and then complete a report with their findings. Their report will then be submitted to Council, and we will make that report available to the community within 4 days of receiving it.

    All information regarding this proposal is available in the Key Documents menu to your right and we have also compiled a 'Public Hearing Pack' to provide some background on the role of a Public Hearing.

    Participating in the forum

    At this stage, Council do not anticipate registration will be required to attend the Hearing, however this is subject to change dependent on NSW Public Health Orders.

    All attendees will be encouraged to participate, however, if you would like to secure a formal opportunity to present at the Hearing, that option is available to you via the registration process outlined below. Registering to speak with also help our facilitator know who is speaking for reporting purposes. To ensure everyone has ample opportunity to share their thoughts, each person will be provided with a few minutes to summarise their key ideas about the reclassification.

    To register to present at the Hearing, please use the tool below, call Council on 1300 087 004, or send an email to admin@murrayriver.nsw.gov.au requesting to be registered to address the Public Hearing. Registrations for presenting at the Hearing will be open until 4pm Friday 17th February 2023.

    We may digitally record the event (for our records only- it will not be publicly released) and we may also be taking some photos on the night.

    Consultation on the Planning Proposal commenced on 30 September 2022 and closed at 4pm on 30 October 2022.

    We did not receive any public submissions in response to this Planning Proposal.

    Consultation is now open on this Planning Proposal! Please use the 'Make a submission' or 'Ask us a question' tabs to share your thoughts, or contact us to have a chat. You can also use the NSW Planning Portal to make a submission.

    Please ensure you provide your feedback by 30 September 2022 so that we have time to incorporate your thoughts into our Council reports for this proposal. To meet the requirements of the Local Government Act 1993 which enable us to reclassify this community land to operational land, we will be hosting an independently-chaired public hearing to seek community feedback on the reclassification. The date and location of the Public Hearing is yet to be set, however we will advertise details of the meeting for at least 21 days before it is held. Pre-registration of attendance will be necessary. More details to come in the near future!
